These Terms of Use ("Terms") govern joinmotherlist.com and The Motherlist's membership, community, activity, and caregiver-list services (together, the "Service"). The Service is operated by PIXEL AGENCY LLC ("Motherlist," "we," "us," or "our").
Agreement to these Terms
By accessing or using the Service, starting checkout, or creating an account, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the Service. You must be at least 18 years old to use Motherlist.
Please read Section 14 carefully. It requires most disputes to be resolved through binding individual arbitration and includes class-action and jury-trial waivers. You may opt out within 30 days.
1. Accounts
Some features require an account and an active membership. You agree to provide accurate, current information and to protect your sign-in credentials. Account authentication is provided by Clerk, whose own privacy practices apply when it processes authentication data on our behalf. You are responsible for activity under your account. Notify us promptly at support@joinmotherlist.com if you suspect unauthorized access. You may request account closure by emailing that address.
2. Membership, founder offer, and renewal
The founding-member offer provides the first 12 months of membership for $0 with a payment method collected at checkout. Unless you cancel before renewal, the membership renews automatically after 12 months at the then-disclosed standard rate, currently $200 per year, and continues annually until canceled.
You authorize Stripe to charge the payment method on file for renewal amounts and applicable taxes. You may cancel before renewal by emailing support@joinmotherlist.com. Cancellation prevents the next renewal and does not remove access during a period already provided, unless we tell you otherwise. Any rights provided by applicable law remain unaffected.
3. A private member community
Motherlist is designed for private, respectful exchange among members. Do not copy, publish, scrape, sell, or distribute another member's posts, identity, contact information, caregiver leads, or other member-only material outside the Service without permission. Privacy depends on every member's judgment, and we cannot guarantee that another user will not screenshot or redistribute information.
4. Community conduct
You may not use the Service to:
- harass, threaten, discriminate against, exploit, or impersonate another person;
- post unlawful, defamatory, fraudulent, deceptive, obscene, or abusive material;
- share private information without the person's permission;
- advertise, solicit, spam, or conduct commercial activity without our permission;
- interfere with security, probe vulnerabilities, introduce malicious code, or overload the Service;
- scrape, harvest, or automate access to member information or content; or
- violate law, another person's rights, or these Terms.
We may review, remove, or restrict posts, replies, listings, or accounts and keep moderation records. Moderation decisions may be made to protect the community even when conduct is not expressly listed above.
5. Your content
You retain ownership of content you submit. You grant Motherlist a non-exclusive, worldwide, royalty-free license to host, store, reproduce, format, display, and distribute that content only as reasonably needed to operate, moderate, improve, and protect the Service. This license ends when the content is deleted from active systems, except for reasonable backups, legal retention, and content others have already copied or shared as permitted by the Service.
You represent that you have the rights and permissions needed to submit your content. Feedback or suggestions may be used by Motherlist without restriction or compensation.
6. Care List
Caregiver profiles, referrals, contact details, vaccination information, experience, training, and availability are supplied by caregivers or referring members. Motherlist may review submissions for completeness and fit, but does not employ caregivers and does not guarantee, independently verify, recommend, or warrant any caregiver or statement in a listing.
Families and caregivers are solely responsible for interviews, references, background checks, licenses, eligibility to work, safety decisions, agreements, compensation, taxes, insurance, and compliance with law. Interactions or arrangements are directly between the people involved.
7. Weekend List and outside services
Activity dates, prices, age guidance, availability, and other details can change. Verify critical information with the organizer before attending. Links to venues, ticketing services, Stripe, Unsplash, and other third parties are provided for convenience. Motherlist does not control or endorse third-party services, and their own terms and privacy practices apply.
8. Motherlist ownership and license
Motherlist and its licensors own the Service, brand, design, editorial selections, software, and content we create. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. No other rights are granted.
You may not reproduce, modify, reverse engineer, sell, license, create a competing database from, or commercially exploit the Service or member-only content except where law does not permit such a restriction.
9. Changes, suspension, and termination
We may change, suspend, or discontinue parts of the Service and may suspend or terminate access if we reasonably believe you violated these Terms, created risk, or harmed the community. Where practical, we will provide notice. Provisions that by their nature should survive termination, including ownership, disclaimers, limits of liability, indemnity, and dispute terms, will survive.
10. Privacy
Our Privacy Policy describes how we handle personal information and is incorporated into these Terms. If these Terms conflict with the Privacy Policy about personal information, the Privacy Policy controls.
11. Disclaimers
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." MOTHERLIST DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE OR ANY MEMBER, CAREGIVER, LISTING, ACTIVITY, LINK, OR CONTENT WILL BE ACCURATE, SAFE, AVAILABLE, SECURE, OR ERROR-FREE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME OF THESE TERMS MAY NOT APPLY TO YOU.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOTHERLIST AND ITS SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, SUBSTITUTE SERVICES, OR HARM ARISING FROM MEMBER OR CAREGIVER INTERACTIONS. OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF $50 OR THE AMOUNT YOU PAID MOTHERLIST DURING THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. THESE LIMITS DO NOT APPLY WHERE LAW PROHIBITS THEM.
13. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Motherlist and its agents from third-party claims and reasonable costs arising from your content, your misuse of the Service, your violation of these Terms or law, or your violation of another person's rights. We may control the defense of a covered claim, and you agree to cooperate.
14. Dispute resolution and JAMS arbitration
Informal resolution first. Before starting arbitration, the person raising a dispute must send a written notice describing the claim and requested relief to support@joinmotherlist.com or the mailing address in Section 16. The parties will try in good faith to resolve the matter, including a phone or video conference within 45 days if requested. Arbitration may begin if the dispute remains unresolved 60 days after notice.
Binding individual arbitration. Except for eligible individual small-claims matters and requests for injunctive relief to protect intellectual property, disputes arising from the Service or these Terms will be resolved by binding individual arbitration administered by JAMS. Claims not exceeding $250,000, excluding interest and attorneys' fees, will use the JAMS Streamlined Arbitration Rules; larger claims will use the JAMS Comprehensive Arbitration Rules. The JAMS Consumer Arbitration Minimum Standards and applicable law govern consumer access and fees. Unless the parties agree otherwise, proceedings may occur remotely or in a location that does not preclude your reasonable access to arbitration.
YOU AND MOTHERLIST WAIVE THE RIGHT TO A TRIAL BY JUDGE OR JURY FOR COVERED CLAIMS. CLAIMS MUST BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY, NOT AS A PLAINTIFF OR CLASS MEMBER IN A CLASS, REPRESENTATIVE, CONSOLIDATED, OR COLLECTIVE ACTION. AN ARBITRATOR MAY AWARD RELIEF ONLY TO THE INDIVIDUAL PARTY SEEKING IT.
Thirty-day opt-out. You may opt out of this arbitration agreement within 30 days after you first accept these Terms by emailing support@joinmotherlist.com or mailing Section 16's address. Include your full name, the email associated with your account, and a clear statement that you are opting out of arbitration. Opting out does not affect the rest of these Terms.
If a court finds the class-action waiver unenforceable for a particular claim, that claim will be heard in the courts identified in Section 15 after all other arbitrable claims are resolved. If any other part of this Section is unenforceable, it will be modified only as much as necessary, and the remainder will stay in effect.
15. Governing law and general terms
California law governs these Terms without regard to conflict-of-law rules, except that the Federal Arbitration Act governs Section 14. Claims not subject to arbitration will be brought exclusively in the state or federal courts located in San Francisco County, California, except eligible individual small-claims matters.
These Terms and the Privacy Policy are the entire agreement about the Service. If a provision is unenforceable, it will be modified to the minimum extent necessary and the remaining provisions will continue. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a business transaction. Electronic notices satisfy legal writing requirements where permitted.
We may update these Terms. We will post the revised version and effective date and provide additional notice for material changes when appropriate. Continued use after the effective date means you accept the revised Terms.
